Question:

Dear Nancy:

Did an actual bill or law pass in my state that says a registered nurse cannot inject Botox or fillers unless under the supervision of a physician? If so, what is the number of that amendment and where is it written in the nurse practice act?

Ron

Dear Nancy replies:

Dear Ron:

There are several sources you can research to try and determine the answers to your questions. The first, and perhaps the easiest place to check, is your state nurse practice act and rules. Your state board of nursing's website might provide updates on changes to the state act for all licensees.

A second option is to go to your state's legislative website and put in the search bar "amendments to (your state) nurse practice act" or "bills affecting (your state) nurse practice act.” The latter can be done for bills already passed or for bills that are pending. There is usually a history of a bill's travel through the legislative process and the information can be quite helpful in determining its process.

On the legislative website, you can also enter "bills affecting nurses injecting Botox" or something similar. This option would be helpful if the prohibition was not placed in the nurse practice act but rather in the medical practice act (due to the requirement of an MD supervising this practice) or another statute that regulates Botox and other fillers.

A third option is to contact your state board of nursing by phone or through an email if your board offers you the option of asking questions of the board.

Last, you can contact your state legislator's office for any updates on nursing practice pending bills or bills that have passed and when it/they will become effective.

Sincerely,
Nancy
