Is there any way that I can get disciplines from 1994-2005 taken off my RN license? The disciplines include suspensions, probation and fines that were paid.
Nancy Brent replies:
Some state boards of nursing have established procedures for the expungement of disciplines. These procedures vary from state to state and are dependent on such factors as the length of time that has passed since the discipline was imposed, if the conditions that were part of the discipline were successfully completed by the licensee, the type of discipline imposed and the basis of the discipline for example, a criminal conviction.
You can research this by reviewing your states nurse practice act and its rules to see if such procedures exist. It is relatively easy to find this information, since many boards of nursing have it on their websites, including FAQs that are presented in a question and answer format.
If its easier, you can consult with a nurse attorney or attorney in your state who can advise you about the current law. If you do consult with an attorney, take with you any and all documentation concerning the disciplines. If expungement is possible in your state, it will also be important to discuss with the attorney how to handle questions that future employers may ask about previous disciplines.
